A man who threatened to kill the next neighbour he saw because he was being kept awake by the noise was put on probation yesterday.

The man phoned his neighbour threatening to bash their head in with the front door and kick the child's head in the next time it made any noise.

But the recorder did not jail him after being told he had not intended to carry out his threat. The defense claims the client had been extremely distressed about the noise from the neighbours two children after sleepless nights.

The court also heard that the man had briefly kidnapped his roommate after the roommate wouldn’t stop talking.

The defense said he was taking a new medication which helped him control his behaviour.

The man, who admitted to false imprisonment and threats to kill, was sentenced to two years probation and ordered to continue his medical treatment.
